HYDERABAD: Proprietors of structures in the prohibited, protected and regulated zones in the Charminar heritage precincts have violated approvals given to them by constructing more floors, Greater Hyderabad Municipal Corporation officials told TOI on Saturday. It was reported earlier that Archaeological Survey of India, the custodian of historic Charminar, had issued notices to three property owners to “remove“ the newly constructed portions. Officials said they had however not received any reply.
GHMC officials said that while the owner of structure 23-1-63 on the east of Charminar had obtained permission from the civic body to build a stilts-plus-two residential building, two additional floors, for which no permission was accorded, had been constructed. Similarly, property owners of the premises bearing number 22-5-297 to 299 obtained permission for constructing a stilts-plus-two structure. However, like the previous case, two additional floors were constructed.
“We have sent notices to both the applicants under Sections 452 (1) and 461(1) of Hyderabad Municipal Act of 1955.These sections direct the applicant to give details of violations before the deputy commissioner, and instruct him to stop construction activity. However, both applicants have approached the court separately and obtained status quo orders,“ said assistant planning commissioner of circle 4 A Mahender said. The GHMC will initiate further action in accordance with court orders, he added.
The GHMC has sent a notice to owner of 22-5-302 near Kali Kaman as he had built three floors when permission had been accorded for only stilts plus-two floors.
Meanwhile, explaining the process of obtaining permissions, superintending archaeologist N Taher said, “Notices are issued by ASI to the incumbent, followed by a show cause notice by (ASI) director general. Instructions are then issued to the collector by the DG to remove the unauthorised structure.
