CHENNAI: Failure to stop illegal constructions on Wakf Board properties, despite a specific high court order and a request from Wakf Board officials, has landed a zonal officer of the city corporation in legal trouble. The first bench of the court has summoned the officer of Adyar zone to be personally present in court on November 24.
The summons came on a PIL which alleged that unauthorised constructions on a Wakf property on Anna Salai in Nandanam was being put up by all leaseholders though the court itself had asked authorities to ensure that no structure came up at the site.
In his PIL, Muhammad Mujeebur Rahman, secretary of Nawab Fazeelathunissa Begum Sahiba Mosque and Endowment Wakf of Anna Salai, Nandanam, said properties on the premises had been leased to various private parties for a rent.
He submitted that he had already filed a writ petition to forbear the lease holders of the property from carrying out any illegal or unauthorised construction without the permission of the Wakf Board. The high court directed the officials of the Wakf Board to see that no illegal construction is carried out by the occupiers.
But, since all the lease holders were proceeding with the unauthorised construction, the Wakf officials requested the corporation authorities to prevent the activities and also asked them not to accord water and electricity connections to the buildings. However, as there was no action on the part of the authorities, the secretary filed the PIL. He prayed for a direction to the authorities to remove unauthorised the construction put up by the occupiers in the property.
Issuing notice to the civic body, assistant executive engineer, Chennai corporation, Adayar zone XIII, the first bench posted the matter to November 24.
