NOIDA: The NCR RWA hail Allahabad high court order of Wednesday directing the removal of DND toll and maintain that judgement will help their petition pending in the Delhi high court on the matter. They also said that they will go a step further and demand action on all those (read bureaucrats) involved in drawing the lopsided agreement on DND.
“We welcome the historic verdict of the Allahabad high court delivered today (Wednesday) on CONRWA PIL against DND toll. The stay on levying any toll at DND flyway by the court was long awaited. The public friendly judgement has come after four years’ of waiting following Supreme Court intervention and confirms the illegality of the operators in this matter,” said Chetan Sharma, secretary general Confederation of NCR Residents Welfare Associations (CONRWA). According to Sharma, ” the Noida Toll Bridge Company Limited (NTBCL which is in-charge of DND toll) have collected much more than the cost of this bridge and was unjustified in continuing the toll tax from the public.”
CONRWA, which too have filed a Public Interest Petition (PIL) in Sept 2015 in the Delhi High Court on the matter and which is pending hearing (slated for Dec 19, 2016), maintain that the Wednesday’s Allahabad High Court order will give further boost to their PIL. “In our petition we have requested the chief justice of Delhi High Court to unearth the fraud played in the name of public-private partnership in connivance with bureaucrats and DND operators as per the concessionaire agreement signed on November 12, 1997 among (i) New Okhla Industrial Development Authority (Noida Authority), (ii) Infrastructure Leasing and Financial Service (IL & FS) and (iii) Noida Toll Bridge Company Limited (NTBCL) over the matter,” said Sharma.
CONRWA will now further demand “a CBI inquiry in the financial transactions of these companies i.e. ILFS and NTBCL by Delhi and Uttar Pradesh governments,” said Sharma. CONRWA PIL is about fraud played by all connected bureaucrats in Delhi-UP- Noida with operators and respondents regarding financial irregularities like Marubeni company of Japan who was initially awarded the contract to build DND and had mentioned Rs.193 crore as tender cost whereas DND flyway had shown Rs.408 core cost while land cost was free. “Many concessionaire agreement conditions were not adhered to like a cycle track was to be constructed which they have not done till date. All retired bureaucrats after retirement joined respondents companies as directors. One main company – ILFS, created many group companies and awarded contracts to them to siphon off huge money,” said Sharma citing details from CONRWA petition.
Meanwhile apart from CONRWA which led many protests, agitations and sit-in dharnas over the past four years to reach the Wednesday’s verdict, others who too had protested for a toll free DND include Janhit Morcha which had resorted to indefinite protests (on Aug 28, 2016) on the matter earlier under the leadership of ex BJP minister Nawab Singh Nagar and Noida Vikas Manch. “The Allahabad high court order of Wednesday is the victory of people of Noida and the many social, cultural, educational as well as industrial organisations and institutes that had been fighting for a toll free DND,” said Nagar.
